Appeal Settlement and Enforcement Support of Industrial Property Rights
In 2024, in addition to managing a substantial workload of appeal application processing, IP Viet Nam successfully handled numerous complex disputes involving prominent industrial property rights (IPR) conflicts.
I. Application Handling
In 2024, IP Viet Nam received 959 appeal requests and 479 requests for cancellation or invalidation of industrial property titles. The Office processed and concluded 1,238 cases, including 1,152 appeal requests and 131 requests for cancellation or invalidation of protection titles.
II. Management Activities
1. Coordination in Enforcement Activities
To support enforcement authorities in addressing IPR infringement cases and related matters, IP Viet Nam issued official letters providing expertise opinions for 95 cases, including: 20 for Market Surveillance Authorities, 2 for Customs, 28 for Economic Police, 8 for Courts, 12 for Inspectorates, and 25 for other agencies.
IP Viet Nam also prepared reports and evaluations on the effectiveness of IPR enforcement and the improvement of the business environment, serving government and parliamentary meetings, as well as international conferences, including:
- - Ten-year summary report on the implementation of Directive No. 35-CT/TW dated May 26, 2014, of the Politburo on strengthening Party leadership over citizen reception and the settlement of appeals and denunciations;
- - Report clarifying improvements in IPR enforcement to meet international commitments and enhance the business environment and national competitiveness, as well as notable, prolonged industrial property disputes, submitted for Government leadership's presentation at the 8th Session of the 15th National Assembly;
- - Report on the implementation of Resolution No. 100/2023/QH15 of the 15th National Assembly regarding IPR enforcement from April to November 2024;
- - 2024 report on citizen reception and the settlement of appeals and denunciations, presented at the 8th Session of the 15th National Assembly;
- - Contribution to the mid-term review report on the implementation of Project 319 on combating counterfeit goods and protecting consumers in e-commerce until 2025;
- - Presentation at the Viet Nam–Japan IPR Protection Workshop, co-organized by the Japan Patent Office (JPO), JETRO, the Directorate of Market Surveillance, and the Inspectorate of the Ministry of Science and Technology;
IP Viet Nam also participated in a joint inspection mission on compliance with industrial property law, conducted in collaboration with the Inspectorate of the Department of Science and Technology of Quang Ninh Province.
2. Legal and Judicial Support Activities
In 2024, IP Viet Nam actively participated in legal and judicial support work. The Office successfully resolved several high-profile, complex disputes concerning trademarks such as "LUFFMAN," "Thuan Thanh," "Hai con Ho Do," "BIA VIET," and others including Vodka Nga, Vodka Men; disputes related to the patent for "Single-pole transformer station"; a patent dispute between SAMSUNG and M&K HOLDINGS; and an industrial design dispute involving "technical trench." These cases were resolved effectively at both first-instance and appellate levels, despite their sensitivity and the intense contention between parties.
3. Development of Legal Instruments on IPR Enforcement and Protection
To meet practical needs and ensure consistency and coherence in the legal framework on IPR enforcement, in 2024, IP Viet Nam contributed comments to the following draft legal documents:
- - Draft Decree amending and supplementing certain provisions of Decree No. 99/2013/ND-CP on administrative sanctions in the field of industrial property;
- - Draft Decree amending and supplementing Decree No. 118/2021/ND-CP on sanctioning authority;
- - Draft Circular amending and supplementing Circular No. 23/2023/TT-BKHCN detailing implementation of the IP Law and its guiding decrees;
- - Draft Circular amending and supplementing Circular No. 263/2016/TT-BTC on the regime for collection, payment, management, and use of industrial property fees and charges.
Enforcement and Appeal Division
