Handling of Applications for Inventions in 2020

In 2020, while the number of invention/utility solution applications filed with the IP Viet Nam by foreigners decreased by 2%, the number of invention/utility solution applications filed by Vietnamese increased by 35%, in comparison with the year of 2019. Particularly, the number of patents for invention/utility solution protection granted in 2020 increased by 57.3% compared to 2019.

In 2020, although the Covid-19 pandemic impacted all aspects of life, the number of invention/utility solution applications filed with the Intellectual Property Office of Viet Nam (IP Viet Nam) still increased in comparison with the year of 2019. Particularly, in 2020, the IP Viet Nam received 8,368 invention/utility solution applications - an increase of about 3.1% compared to 2019. While the number of invention/utility solution applications filed by foreigners decreased by 2%, the number of invention/utility solution applications filed by Vietnamese increased by 35% (1,505 invention/utility solution applications of 2020 in comparison with 1,115 applications of 2019). It proves that demand and awareness of patent protection of domestic organizations and individuals had been significantly increased. It also was a result of the IP Viet Nam’s efforts to outreach and raise awareness of protection of intellectual property rights and to train skills of patent searching and patent description writing for research institutions, universities, businesses and researchers.

In order to meet increasing demands from the society, the IP Viet Nam carried out many solutions to increase productivity of handling patent applications. The IP Viet Nam amended and supplemented a number of articles of the 2010 Examination Manual of Invention/Utility Solution Applications to comply with new legal provisions as well as to provide for new provisions on examination over requests for amendment/assignment of invention/utility solution applications, and to make clear responsibilities of each title during examination process. The Patent Examination Center (of IP Viet Nam) employed a consistent set of document templates for simplifying and standardizing the examination process of invention/utility solution applications.

In order to improve quality of invention/utility solution application examination, the IP Viet Nam has provided a full range of search tools and organized seminars and field trips for exchanging expertise and updating knowledge of new technology for examiners. In June 2020, the Patent Examination Center organized a seminar on "Improvement of Examination Manual and Establishment of a Quality Management System for Invention/Utility Solution Application Examination" for sharing solutions/practices to improve productivity and quality insurance of invention/utility solution application examination. In order to improve the examination capacity and in-depth knowledge of new technologies for patent examiners and staff of related divisions/centers, the IP Viet Nam organized an advanced training course on “Trends of Applied Technology Development for Automobile” on 8 and 9 September 2020 at its headquarters, etc.

As a result, in 2020, the number of invention/utility solution applications completely substantive examined (refused or granted) was 7,155 (an increase of about 16.1% compared to 2019). In particular, the number of invention / utility solution protection titles granted in 2020 increased by 57.3% compared to 2019. Regarding formality examination, 7,842 invention/utility solution applications were accepted as valid applications (an increase of about 7.15% compared to 2019). There were 450 requests for amendment/assignment of patent applications recorded (an increase of 59% compared to the same period in 2019).

Within framework of the RPEM Program Phase II, the IP Viet Nam has assigned the Patent Examination Center to develop a Guidelines for Invention and Utility Solution Application Examination and to research for solutions to improve efficiency of invention and utility solution application examination quality management.

In 2021, the Patent Examination Center (of IP Viet Nam) shall promote proactivity and creativity at work and comprehensively deploy solutions with the goal to shorten the examination time and improve invention/utility solution application examination quality in order to better contribute to promote innovation activities and socio-economic development.
